1. Definition

Company," "we," "our," and "Pumpkin Pop Decor" refer to Pumpkin Pop Decor.

"Customer," "you," and "your" refer to the individual purchasing our products or services.

"Display" refers to all pumpkins, accessories, and decorative materials installed by Pumpkin Pop Decor.

2. Booking & Payment

Your booking is confirmed only after full payment has been received and you receive a confirmation email from Pumpkin Pop Decor. All prices are listed in Canadian dollars (CAD) and are subject to applicable taxes.

3. Installation

Our team will professionally design and install your pumpkin display on the scheduled installation date. Installation dates are assigned based on our delivery schedule. While we do our best to accommodate preferred installation dates, they cannot be guaranteed.

If access to the installation area is not available upon arrival, additional service charges may apply for a return visit.

You do not need to be home during installation, provided we have safe and unobstructed access to the front entrance.

In the event of severe weather or circumstances beyond our control, installation dates may be adjusted. Customers will be notified as soon as possible.

4. Natural Products

Pumpkins are natural agricultural products. Every pumpkin is unique in size, shape, colour, texture, markings, and lifespan.

Photos shown on our website are examples of our design style. Because every display is custom-designed using natural materials, your display will not be identical to the photos.

Because pumpkins are natural products, their lifespan naturally varies depending on weather conditions, sunlight, temperature, and care. Pumpkin Pop Decor cannot guarantee how long individual pumpkins will last.

5. Pumpkin Selection

Pumpkin Pop Decor carefully selects all pumpkins used in each display.

The number, varieties, colours, sizes, and specialty pumpkins included may vary depending on seasonal availability, weather conditions, and harvest quality. If a particular variety is unavailable, we reserve the right to substitute a similar pumpkin of equal or greater quality and value.

Minor cosmetic imperfections are normal characteristics of natural pumpkins and are not considered defects.

6. Package Sizes

Package descriptions, Pumpkin counts, display dimensions, and overall appearance are approximate and may vary depending on the size and layout of your entrance. and intended as general guidelines. Every installation is custom-designed to best suit your home’s entrance, layout, and overall appearance.

7. Property Access

By booking our service, you authorize Pumpkin Pop Decor to access the front exterior of your property for installation and, where applicable, removal of the display, if pickup service was purchased.

Customers are responsible for ensuring the installation area is safe, accessible, and free of obstacles.

Customers are responsible for obtaining any required permission from landlords, condominium corporations, or property managers before installation.

8. Customer Responsibilities

Once installed, customers are responsible for the care of the display.

To help maximize the life of your pumpkins:

• Do not lift or carry pumpkins by their stems.
• Avoid moving the arrangement after installation.
• Keep pets from damaging the display where possible.
• Handle pumpkins carefully if they must be moved.

9. Weather & Nature

Pumpkin Pop Decor is not responsible for damage or deterioration caused by:

• Extreme heat or cold
• Frost or freezing temperatures
• Heavy rain, wind, hail, or storms
• Wildlife, squirrels, birds, or other animals
• Insects
• Theft or vandalism
• Accidental damage by people or vehicles
• Natural aging or decomposition of pumpkins

or any other circumstances beyond our reasonable control.

Pumpkin Pop Decor shall not be responsible for delays or inability to perform services due to events beyond our reasonable control, including severe weather, crop failures, transportation disruptions, labour shortages, natural disasters, or government restrictions.

10. Quality Promise

If a pumpkin becomes severely damaged due to a quality issue please contact us within 7 days of installation and provide clear photographs of the affected pumpkin(s).

If we determine the issue is due to pumpkin quality rather than weather, wildlife, accidental damage, or customer handling, we may, at our sole discretion or replace the affected pumpkin(s) subject to seasonal availability and our service schedule.

11. Cancellations

Because pumpkins are reserved and purchased specifically for each customer, all bookings are final and non-refundable.

If you are unable to use your booking at the original installation address, you may transfer your package to another address within our service area, subject to availability and scheduling within one month of purchase date.

Requests to change the installation address should be made in writing as early as possible. While we will do our best to accommodate your request, changes cannot be guaranteed.

12. Changes to Orders

Requests to change package size, colour palette, or installation date are subject to availability and may not be possible after pumpkins have been ordered, sourced, reserved, or prepared.

Additional charges may apply if changes require extra travel, labour, or materials.

13. Photography

Pumpkin Pop Decor may photograph completed installations for quality control, marketing, social media, and website purposes.

To help protect your privacy, our photos do not include your street address.

If you prefer that photos of your display not be used for marketing or social media, please notify us in writing at least 24 hours before your scheduled installation, and we will gladly respect your request.

14. Limitation of Liability

Pumpkin Pop Decor’s total liability is limited to the amount paid for the purchased service.

We are not responsible for indirect, incidental, special, or consequential damages arising from the use of our products or services.

15. Website Information

We strive to ensure all information on our website is accurate and up to date. However, prices, package details, availability, and policies may change without prior notice.

16. Intellectual Property

All website content, photographs, logos, designs, and branding are the property of Pumpkin Pop Decor and may not be copied, reproduced, distributed, modified, published, or used without prior written permission.

17. Property Condition

While our team takes great care during installation, Pumpkin Pop Decor is not responsible for existing property defects, unstable steps, loose railings, uneven surfaces, or pre-existing damage that may affect installation.

We are not responsible for damage resulting from any conditions unknown to us.

18. Refusal of Service:

Pumpkin Pop Decor reserves the right to refuse or discontinue installation where conditions are unsafe, access to the property cannot reasonably be obtained, or where, in our reasonable judgment, completing the installation is impractical or would pose a risk to our team, the property, or the display.

19. Right to Cancel the order

Pumpkin Pop Decor reserves the right to cancel or refuse any order due to circumstances including but not limited to product shortages, safety concerns, pricing errors, or events beyond our reasonable control. If payment has already been received, a full refund will be issued.

20. Display Design

Every display is professionally designed by Pumpkin Pop Decor based on your selected package, the layout of your entrance, available seasonal inventory, and our design expertise. Final layouts, pumpkin placement, and design details are determined solely by Pumpkin Pop Decor and may vary from examples shown on our website

Once installation is complete, Pumpkin Pop Decor is not responsible for displays that are moved, rearranged, or altered by the customer or any third party.

21. Service Area

Pumpkin Pop Decor currently provides installation services within our designated service areas. Service availability may vary by location, and additional travel fees may apply outside our standard service area.

22. Customer Liability

Once installation is complete, customers assume responsibility for maintaining a safe environment around the display. Pumpkin Pop Decor is not responsible for injuries resulting from the customer's use, relocation, or maintenance of the display.

Customers are responsible for providing accurate contact information, installation address, gate codes, and any special access instructions. Pumpkin Pop Decor is not responsible for delays or additional charges resulting from inaccurate or incomplete information.

23. Pumpkin Disposal

If the optional pickup service was not purchased, customers are solely responsible for removing and disposing of pumpkins after the season.

24. Customer Satisfaction

We take great pride in every installation. If you have any concerns regarding your display, please contact us within 24 hours of installation so we have an opportunity to address the issue before making changes yourself.

25. Payment Charge Back

Customers agree to contact Pumpkin Pop Decor before initiating a chargeback or payment dispute so we have an opportunity to resolve the issue.

26. Governing Law

These Terms & Conditions are governed by the laws of the Province of Ontario and the applicable laws of Canada.

27. Acceptance of Terms & Policies

By placing an order, completing payment, or using our services, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
